Pharmaceutical Marketing Regulation Information

Enacted Laws: As of January 2007, eight states and District of Columbia (2003), California (2004, 2005, 2006), Florida (2006) Maine (2003, 2005), New Hampshire (2006), South Carolina (2006), Vermont (2002) and West Virginia (2001) and Minnesota (1993) have laws or resolutions affecting pharmaceutical marketing.

Of those eight states, only five specify reporting requirements in regards to "gifts to practitioners". The states and districts requireing at least annual reporting of marketing expenditures are Minnesota, Vermont, Washington D.C., Maine and West Virginia.

During 2007, at least 27 states propose legislation requiring marketing disclosures by drug manufacturers, regulating direct-to-consumer advertising of prescription drugs by pharmaceutical companies or prohibiting prescription information from being sold for commercial purposes.
